OpportunityToServe, LLC

Effective Date: May 22, 2026

By accessing, logging in to, or otherwise using OpportunityToServe.com, including any content, material, functionality, or services offered on or through the Site (collectively, the "Site"), you agree to the terms and conditions set forth in this Agreement. For purposes of this Agreement, "you" and "your" refer to the individual user of this Site or, if the user is using this Site on behalf of an entity, "you" and "your" include the user and that entity. If you disagree with any of the terms or conditions of this Agreement, do not use this Site. We reserve the right to change this Agreement at any time; please check for changes each time you use this Site. Your continued use of this Site following the posting of changes means that you accept those changes.

DEFINITIONS

Campaign: A fundraising page on OpportunityToServe.com

Campaign Owner: A person that creates a campaign on OpportunityToServe.com to receive donations. Campaign owners have access to messages sent to their campaign page where applicable. A Campaign Owner may create a campaign on behalf of another person or organization, but funds will only be disbursed to the verified Recipient upon successful completion of OpportunityToServe's compliance process.

Donations: Are contributions to individuals, for-profit or non-profit organizations, or are payments to political candidates or committees. Donations are voluntary and do not constitute a purchase of goods or services. Donations are non-refundable except as provided in these Terms.

Donor: An individual or organization that submits a financial donation to a campaign on OpportunityToServe.

OpportunityToServe Light Givers: Donors who have agreed to give a monthly recurring Donation to an OpportunityToServe category of their choosing via OpportunityToServe.com.

OpportunityToServe, LLC ("Company," "we," or "us"): A Wyoming limited liability company that owns and operates OpportunityToServe.com and provides the Services described in this Agreement. OpportunityToServe, LLC is a separate legal entity from OpportunityToServe and is not a 501(c)(3) tax-exempt organization.

OpportunityToServe: A registered 501(c)(3) nonprofit organization separate from OpportunityToServe, LLC and not the operator of this Site. Donations made directly to OpportunityToServe may be tax-deductible, subject to IRS guidelines. OpportunityToServe may utilize OpportunityToServe.com for certain fundraising and grant-issuing activities.

Organizer: A User who creates or manages a campaign, need, group page, school page, or other listing on the Site, including Campaign Owners and authorized representatives of organizations.

Organization Account: An account or page created on behalf of a school, group, team, ward, stake, business, or other organization, including pages managed by designated administrators.

Recipient: The designated person who receives the funds raised from a campaign and may access details about Contributors as permitted under these Terms.

User: User refers to any individual interacting with OpportunityToServe.com, including Donors, OpportunityToServe Light Givers, Campaign Owners, Recipients, and visitors who engage with the platform with or without creating an account.

In-Kind Contribution: A non-cash contribution of goods or materials coordinated via OpportunityToServe's platform features.

Service Contribution (Volunteering): A pledge of volunteer time or services coordinated between Supporters and Organizers via OpportunityToServe's platform features.

Is OpportunityToServe really free?

Yes, OpportunityToServe is really free! We offer a 0% platform fee so that Campaign Owners and Recipients can keep most of their donations. Please note that PayPal will take a processing fee before the money reaches us for disbursement to organizers. Please see our pricing and fees page for more details.

What is our Payment Routing Guarantee?

OpportunityToServe, LLC provides a limited Payment Routing Guarantee to Campaign Owners and Donors. Subject to successful payment processing, applicable verification, compliance review, fraud prevention measures, chargebacks, holds, and the terms of this Agreement, Donations made through the authorized payment flows on OpportunityToServe.com will be routed to the Recipient identified in the applicable campaign or checkout flow.

This Payment Routing Guarantee is not a guarantee of a campaign's truthfulness, legitimacy, outcome, safety, tax treatment, or proper use of funds by any Recipient, Campaign Owner, or third party. We do not guarantee that any campaign will achieve its stated goals, that any good or service will be delivered, or that any volunteer or in-kind activity will occur as described. Donors are solely responsible for evaluating campaigns and Recipients before contributing.

If you believe a Donation processed through our authorized payment flows was misrouted due to a platform processing error, email support@OpportunityToServe.com to request a review. We may review campaigns for policy and compliance purposes before or after disbursement, but such review does not constitute an endorsement, investigation, or guarantee of any campaign or Recipient.

Payment and account information submitted through the Services is transmitted using industry-standard encryption and security practices implemented by us and our payment processors. No method of transmission or storage is completely secure.

What is OpportunityToServe.com?

OpportunityToServe.com is a global online crowdfunding and charitable donation platform, providing users the ability to fund a variety of user-generated campaigns with designated individuals, businesses, for-profit, non-profit organizations, and United States political candidates receiving the donations. Standard credit and debit card fees apply. You are agreeing to our Terms and Conditions in order for us to process your Donation and distribute the proceeds to the designated funding destination and/or host your fundraising campaign.

Additional features we provide:

  • In-Kind Contributions: Tools to list, pledge, and coordinate delivery of physical goods between Donors and Organizers.
  • Service Contributions (Volunteering): Tools to pledge and coordinate volunteer time/services.
  • Coordination Tools: Messaging/logistics features to help arrange pickup, delivery, or scheduling (where available).
  • Optional Tips: Donors may optionally tip OpportunityToServe to support platform operations (the platform fee remains 0%).

Payments are issued after a bank account is linked via the User Dashboard. OpportunityToServe disburses funds to recipients via PayPal, ACH transfers enabled by PayPal, or other PayPal disbursement methods. By receiving funds through OpportunityToServe, recipients authorize OpportunityToServe and its banking partners to process and transmit payments on their behalf within 1–2 business days of a request. In the event that fraud or compliance checks are required, additional time may be required. If you have any questions please feel free to email Support@OpportunityToServe.com.

Prohibited Campaigns

OpportunityToServe does not allow campaigns that;

  • Benefit groups that support physical violence of any kind.
  • Promote or fund abortions.
  • Promote or fund gender reassignment surgeries for minors.
  • Raise funds for illegal activities.
  • Impersonate individuals or organizations.
  • Fail to provide sufficient details or transparency about fund usage.

All campaigns are subject to internal review for compliance, and OpportunityToServe reserves the right to cancel or suspend any campaign for any reason.

These Terms of Service (this "Agreement"), are made between you ("you" or "User" ), and OpportunityToServe, LLC, a Wyoming limited liability company ("we" or "us"), and govern the terms and conditions of your access to and use of our Services (as defined below). However, if you have entered into this Agreement on behalf of an entity, such as a corporation or limited liability company then "you" or "User" refer to the entity, and you represent and warrant that you have power and authority to enter into this Agreement on behalf of the entity.

This Agreement also includes and incorporates by reference any operating rules, policies, price schedules, or other supplemental documents which may be published generally from time to time by us, both prior and subsequent to the effective date of this Agreement.

By registering for and/or using any of the Services, you confirm your acceptance of, and agree to be bound by, this Agreement.

Licenses and Restrictions

This Site is owned and operated by OpportunityToServe, LLC, a Wyoming limited liability company with its principal offices in Wyoming, U.S.A. ("we", "us", or similar terms). All material found at this Site (including all content, visuals, audio, text, icons, displays, databases, media, products, processes, and information) is owned or licensed by us. Unless otherwise indicated, you may view, download, and print materials from this Site only for your personal, noncommercial use in connection with your lawful use of the Services.

Materials may not be posted from this Site to another website or computer network without our prior written permission. Any other use of information or materials found at this Site, including any use by organizations or legal entities beyond your personal use of the Services, is not permitted without our prior written permission. In any case, you may not use this Site or information found at this Site (including the names, contact information, or addresses of those who have submitted information to this Site) to sell or promote products or services unrelated to the Services, to solicit clients, or for any other commercial purpose without our prior written consent. Moreover, you may not delete or alter any copyright, trademark, or other proprietary rights notices on permitted copies of materials from this Site.

Notwithstanding the foregoing, we reserve sole discretion and right to deny, revoke, and limit use of this Site, including the reproduction and any other use of any material available through this Site. It is not our responsibility to determine what "fair use" means for users wishing to use materials from this Site; that remains wholly the responsibility of individual users. Furthermore, we are not required to give additional source citations or to guarantee that the materials of this Site are cleared for any alternate use. We maintain the right to prevent infringement of our materials and to interpret "fair use" as we understand the law.

You acknowledge and agree that no right, title, or interest in and to this Site, any linked website, or any materials on this Site or on any linked website is transferred to you, and all rights not expressly granted are reserved by us.

Code of Conduct

You agree that you will not individually, or as part of any collective effort, submit or post information to this Site that could be deemed harmful or offensive to other users, nor will you impersonate another user in order to hide your identity or to implicate another in such actions. You further agree not to:

  • use any robot, spider, or other automatic device, process, or means to access this Site for any purpose, including, without limitation, for monitoring or copying any of the material on this Site, except as expressly permitted in Section 12 (Anti-Scraping Clause) or with our prior written consent;
  • use any manual process to monitor or copy any material on this Site, or for any other purpose not expressly authorized in this Agreement, without our prior written consent;
  • attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of this Site, the server on which this Site is stored, or any server, computer, or database connected to this Site or any linked website;
  • attack this Site via a denial-of-service attack or a distributed denial-of-service attack;
  • introduce any virus, trojan horse, worm, logic bomb, or other material that is malicious or technologically harmful; or
  • do anything that might disrupt the flow of data to or from this Site, impact the service or performance of this Site, or otherwise circumvent any of the controls or usage rules that we have implemented.

You understand and agree that the result of harmful or offensive actions (and of any breach of this Agreement) immediately terminates your right to use this Site and its materials, and may include legal action against you. Upon termination of your right to use this Site, you must (at our option) return or destroy any copies of materials from this Site that you have made.

Interactions with Others

This Site provides a platform for individuals and organizations to learn about, coordinate, and support charitable, volunteer, in-kind, and fundraising opportunities. We are not a party to, have no involvement or interest in, make no representations or warranties as to, and have no responsibility or liability with respect to any communications, transactions, interactions, disputes, or relations whatsoever between you and any other person or organization, whether or not you found or otherwise interacted with such person or organization through, or as a result of your use of, this Site.

We cannot and do not confirm the identity of any person or organization using this Site. You are solely responsible for determining the identity and suitability of others with whom you may interact through, or as a result of using, this Site. We do not represent or warrant that this Site is sufficient to determine whether it is appropriate for you to interact with others. Further, we do not endorse any persons or organizations who register on, are displayed on, or who otherwise use this Site.

We do not investigate or verify any person or organization's reputation, conduct, morality, or criminal background; the legitimacy of any posting, campaign, need, service opportunity, or volunteer opportunity; or any other information others may submit to this Site. Instead, the burden is on you to investigate the legitimacy of any such person, organization, posting, campaign, or opportunity. Please be aware of scammers. Service and volunteer opportunities presented through this Site are intended to help others through donations of time, funds, goods, or coordinated efforts as described on the Site. If any person or organization you encounter through this Site requests that you contribute money outside of the Services' authorized payment flows, or asks you to do anything that may reasonably be deemed inappropriate, fraudulent, or unsafe, you should notify us immediately at support@OpportunityToServe.com, as such conduct may be contrary to our policies and the purpose of this Site.

User Content

The services provided on this Site allow you to post content relating to campaigns, needs, donations, service opportunities, volunteer coordination, and related activities. That content may include images, descriptions, files, trademarks, service marks, tradenames, personal data, and other content or information (any such materials that you or another user submits, posts, displays, or otherwise makes available on this Site is referred to as "User Content"). You retain ownership of your User Content and may request (at any time) that we remove it from this Site, subject to our legal, regulatory, and operational obligations. We reserve the right to refuse to accept, or to remove from this Site, any User Content for any reason, such as if we believe that it may subject us to legal liability or that it may violate this Agreement.

You agree not to post User Content that:

  • may create a risk of harm, loss, emotional distress, death, disability, disfigurement, or physical or mental injury or illness to you, to any other person, or to any animal;
  • may create a risk of any other loss or damage to any person or property;
  • seeks to harm or exploit children by exposing them to inappropriate content, asking them for personally identifiable information, or otherwise;
  • may constitute or contribute to a crime or tort;
  • contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to any person or organization (publicly or otherwise), libelous, threatening, profane, discriminatory, indecent, malicious, or otherwise objectionable;
  • contains any information or content that is illegal;
  • contains any information or content that you do not have a right to make available under any law, including under any data protection law, or due to any contractual or fiduciary relationship;
  • contains any information or content that you know or believe is not correct and current; or
  • promotes, or otherwise incites, discrimination, racism, bigotry, hatred, or physical harm of any kind against any group or individual.

You agree that any User Content you post to this Site does not and will not violate any third-party right of any kind, including, without limitation, any Intellectual Property Rights (as defined below). To the extent that your User Content contains any third-party content, you hereby represent that you are the owner of, or have a valid license to, all the Intellectual Property Rights of such third-party content, and have the power to grant the license granted below. You hereby represent that you have the written consent and waiver of each and every identifiable natural person whose name, image, or likeness appears in your User Content to use and allow us and this Site's users to use such person's name, image, and likeness in the manner contemplated by this Site and by this Agreement, and each such person has released you, us, and our sublicensees from any liability that may arise in relation to such use. You will supply us with these written consents if we request you to do so. We reserve the right, but not the obligation, to reject and/or remove any User Content that we believe, in our sole discretion, violates these Terms without admission or liability.

For the purposes of this Agreement, "Intellectual Property Rights" means any and all patent rights; copyright rights; moral rights; rights of publicity and rights of privacy; trademark, trade dress, and service mark rights; goodwill; trade secrets; and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefor and registrations, renewals, and extensions thereof, under the laws of any state, country, territory, or other jurisdiction.

To the extent permitted by applicable laws, we assume no responsibility and we assume no liability for any User Content that you or any other user or third party posts on this Site. You will be solely responsible for your User Content and the consequences of posting and publishing it, and you agree that we are only acting as a passive conduit for the online display of your (and others') User Content. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited for your purpose, and you agree that we will not be liable for any damages you allege to incur as a result of any such User Content.

To the fullest extent permitted by law, you acknowledge that OpportunityToServe, LLC is an interactive computer service provider and that we are not the publisher or speaker of User Content posted by users or third parties. Nothing in this Agreement shall be construed to limit any defense, immunity, or protection available to us under applicable law, including 47 U.S.C. § 230 or similar laws. We may remove, restrict, or refuse User Content in our sole discretion, with or without notice, and without liability.

User Content License Grant

By posting any User Content on this Site, including, without limitation, your or another's name, likeness, logo, tradename, trademark, service mark, or copyrighted materials, you expressly grant to us, and you hereby represent and warrant that you have all rights necessary to grant to us, a royalty-free, fully-paid-up, sublicensable, transferable, perpetual, irrevocable, non-exclusive, and worldwide license to use, reproduce, modify, publish, transmit, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content, in whole or in part, and in any form, media, or technology, whether now known or hereafter developed, in any and all manners that we deem appropriate in connection with operating, promoting, securing, and improving the Services. To the fullest extent permitted by law, you hereby waive and agree not to assert, any and all so-called "moral rights" now or hereafter recognized with respect to your User Content and to each and every part thereof for any and all now-known or hereafter existing uses, media, and forms, including, without limitation, any and all of your rights arising under Section 106A of the U.S. Copyright Act (entitled "Rights of Certain Authors to Attribution and Integrity").

No Control Over Third Parties

No campaigns, needs, service opportunities, meetings, events, organizations, recipients, or individuals listed on this Site are controlled by us, and individuals participating with such do so at their own risk.

Remember, this Site is a platform that enables you to communicate and interact with other people and organizations in your community and around the world. We cannot be responsible for the interactions that you have with other individuals on, through, or as a result of your use of this Site, so please use good judgment and keep safety in mind when you use this Site.

Because this Site is merely a platform, in the event that you have a dispute with one or more persons or organizations, you release us (and our officers, directors, members, managers, employees, agents, volunteers, and affiliates) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Volunteer, In-Kind, and In-Person Activities

The Services may help Users coordinate volunteer time, service contributions, and in-kind donations of goods or materials. OpportunityToServe, LLC does not organize, supervise, manage, direct, or control any in-person activity, pickup, delivery, storage, transportation, event, or volunteer assignment, and does not provide insurance, background checks, licensing verification, safety training, or professional oversight for any such activity.

You participate in any volunteer, service, in-kind, pickup, delivery, or other in-person activity arranged through or discovered via the Site entirely at your own risk. Organizers, Campaign Owners, Recipients, volunteers, donors, and all other participants are solely responsible for compliance with applicable laws, permits, safety rules, child-protection requirements, vehicle and property rules, food-handling requirements, medical or professional licensing requirements, and for obtaining any insurance they deem necessary.

To the fullest extent permitted by law, OpportunityToServe, LLC is not liable for any injury, death, loss, theft, property damage, delay, no-show, dispute, misrepresentation, or other harm arising out of or related to volunteer activities, in-kind contributions, logistics coordination, or any in-person interaction between users, whether on or off the Site.

Organization and Group Accounts

The Services may allow schools, groups, teams, religious organizations, businesses, and other entities to create Organization Accounts or related pages. If you create, administer, or use an Organization Account, you represent and warrant that you have authority to act on behalf of that organization and to bind it to this Agreement.

Organization administrators are solely responsible for permissions granted to sub-users, moderators, teachers, coaches, leaders, and other delegates; for obtaining any required consents from members, parents, guardians, employees, or participants; and for all campaigns, needs, listings, communications, and content posted under the organization's account. We do not verify organizational authority beyond the information and representations you provide.

Any dispute arising between an organization and its members, donors, volunteers, students, parents, or other participants is solely between those parties. OpportunityToServe, LLC is not responsible for internal organization governance, membership decisions, or delegated access.

Payment Processors and Third-Party Services

Payment processing, identity verification, fraud screening, banking, disbursement, and related financial services may be provided by third parties such as PayPal and their banking partners. Those providers are independent contractors and not agents, partners, or employees of OpportunityToServe, LLC.

We are not responsible for any act, omission, delay, hold, freeze, account limitation, rejection, reversal, fee, error, or unavailability caused by a payment processor or other third-party service provider. Your use of third-party services may be subject to separate terms and privacy policies imposed by those providers.

OpportunityToServe Trademark

"OpportunityToServe" and related marks are trademarks of OpportunityToServe, LLC. By using this Site, we hereby grant to you limited, royalty-free, non-transferable, non-exclusive, revocable, and worldwide permission to use, reproduce, display, and publish the "OpportunityToServe" trademark in any form, media, or technology, whether now known or hereafter developed, for use solely in connection with your authorized use of this Site and in accordance with this Agreement. You agree that we can unilaterally revoke this limited permission at any time and for any, or no, reason. Except as expressly permitted herein, you may not use our name, logo, trademark, trade names, or service marks without our prior written consent.

Linking to Third-Party Websites

For your convenience, this Site may contain links to websites operated by others. Such third-party websites are not maintained or controlled by us, and we are not responsible for their content. Although we have made a good-faith effort to link only to appropriate websites, some may contain inappropriate or objectionable material. If you find such material while using a website that you accessed through a link on this Site, please notify us immediately at support@OpportunityToServe.com.

We do not control, endorse, or adopt any third-party content and we have no responsibility for the same, including, without limitation, material that may be misleading, incomplete, erroneous, offensive, indecent, or otherwise objectionable. You must evaluate and bear all risks associated with third-party content.

We believe that those who make information available on the Internet expect that it will be publicly and widely available. Therefore, we believe that linking to other websites is legally permissible and consistent with the expectations of those who use the Internet. However, if access to a particular website should be restricted, the operator of such website should promptly notify us.

1. Our Services

OpportunityToServe, LLC owns and operates OpportunityToServe.com, which operates with a mission to share hope through crowdfunding, inspired by values of compassion and generosity. This guides our policies but does not restrict use by any individual or causes unless it violates these Terms.

OpportunityToServe.com provides a quick and easy method for Users to give donations, or create a social fundraising campaign page to facilitate online payment of lawful Donations to authorized recipients ("Recipients") globally (the "Services"). We have no control or liability for the acts or omissions of the Recipients of Donations, or of any other entities or their web sites describing the Services or displaying Donation pages or other portions of the Services. Volunteers and donors of in-kind items act independently of OpportunityToServe; OpportunityToServe does not supervise interactions or logistics. Participants are solely responsible for safety, insurance, qualifications, background checks, and compliance.

2. OpportunityToServe Responsibilities to Users

In accordance with terms and conditions contained herein, if you are a User, OpportunityToServe will perform, and You authorize OpportunityToServe to provide as Your agent and on Your behalf, the following services (the Services). OpportunityToServe will:

  • receive and process online Donations made by individuals or entities through the OpportunityToServe.com platform;
  • hold the funds received through the OpportunityToServe platform in a non-operating account; Funds contributed through OpportunityToServe are held temporarily in a segregated account solely for the purpose of facilitating donations to recipients. OpportunityToServe does not act as a custodian or hold funds on behalf of individuals beyond what is necessary for processing payments and ensuring compliance with legal obligations;
  • remit funds to the designated funding destination by electronic transfer to the bank account provided by the funding destination, or by other means as deemed appropriate by OpportunityToServe, less a payment processing fee. In some cases, there may also be a service fee and/or additional processing fees. Fees are outlined in Section 4 of these terms and conditions and are subject to change at any time at the discretion of OpportunityToServe;
  • with all donations; send reports identifying, where available, the transaction accounting details of the Contributors who have made Donations to the Campaign Owner and Recipient along with the amount and date of the donations, and the name and email address for any user responsible for a single donation to that campaign of $5 or more;
  • in the event of political election donations only; provide reports identifying, where available, the name, email, address, employment information, answers to applicable disclosures, and transaction accounting details of the Contributors who have made Donations to their organizations along with the amount and date of the donations;
  • comply with the Privacy Policy set forth at https://www.OpportunityToServe.com/privacy-policy;
  • electronic communications from OpportunityToServe will be sent to Users to inform them of a variety of events that inform them about activity on OpportunityToServe. You agree to allow OpportunityToServe to send these communications to your email address. You also agree that OpportunityToServe is not liable for any user generated content that is sent to you as a part of these communications. You agree that you are liable for any communications you send to potential Donors promoting your Campaign. These communications include, but are not limited to, emails sent through the OpportunityToServe.com website and communications sent outside of the OpportunityToServe system;
  • OpportunityToServe acts as the authorized agent of the recipient for the purpose of receiving and processing donations on their behalf. A Donor's Donation to an OpportunityToServe campaign fulfills the Donor's obligation to the recipient, and the recipient agrees that OpportunityToServe's receipt of funds on their behalf constitutes receipt by them.
  • OpportunityToServe does not guarantee that Donations will be accepted by Recipients. While we strive to ensure the successful processing of Donations, we assume no liability if a Recipient does not claim or utilize funds.

3. User Responsibilities

A. Eligibility.

You represent that you are at minimum the age of requirement within the country you reside in. You must be at least 18 years old to receive funds through the Services. You represent that you have legal power and capacity to form a binding contract and are not barred from receiving the Services under the laws of the United States or other applicable jurisdictions. You further represent that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions or embargoes, and that you are not identified on any U.S. or applicable international sanctions, denied-party, or restricted-party list. Eligibility for specific Services is subject to further requirements on various website pages for the Services.

B. Registration and Equipment Obligations

By visiting OpportunityToServe.com you are responsible for protecting your equipment (computer, etc.) from any harm resulting from a visit to the website.

You shall provide true, current, and complete information about yourself on our online or offline registration forms, including but not limited to your name, contact information, and payment information (such as the expiration date of any credit or debit card). We also may require further information in order to verify your identity and information, such as confirming your email address, occupation, or employer, to comply with campaign finance disclosure laws, and to provide non-profit organizations with a list of Contributors. We reserve the right to verify your information with third parties. If you fail to provide the required information, or we have reasonable grounds to suspect that any such information is not true, current and complete, we may limit, suspend, or terminate your use of any or all portions of the Service.

You are responsible for obtaining at your expense all equipment and third-party services (e.g., Internet access and email service) necessary for you to access and use the Services, and for all related charges resulting from use of the Services. You will immediately notify us of any unauthorized use or other breach of security of the Services.

C. Use of the Services

We may establish or revise from time to time at our discretion general practices and limits (including the Acceptable Use Policy below) concerning your use of the Services. Should your use not comply with such practices and limits, we may at our discretion limit, suspend, or terminate the Services to you, and may contact law enforcement and affected banks, credit and debit card issuers and recipients, and other third-party payment processors.

We may at our discretion establish or revise limits on the amount of money you can contribute through the Services (in total, to a particular campaign, to a particular funding destination, for a particular time period, and/or otherwise). Some of these limitations may be required by law.

Your Donations also are limited by the available credit on your credit card or your available account balance on your debit card or bank account, on the date of Donation and/or processing. You are solely responsible for over-limit fees, overdraft fees, finance charges and the like imposed by your bank or card issuer if your Donation(s) exceed your available credit limit or account balance.

The full amount of each Donation that you make using the Services (less any fees charged to you under this Agreement) constitutes a "Donation" to a Recipient that is a political candidate or committee and a "donation" to a Recipient that is a for-profit or non-profit organization, individual, or business. OpportunityToServe makes no representation or warranty that any Donation is tax-deductible. You agree to be responsible for the tax reporting and characterization of any Donation by OpportunityToServe for your account to any Recipient.

Donations via the Services will be made in the currency of the Recipient's home country.

You do not purchase any goods or receive any services from any Recipient in return for your Donation. In the event the Campaign Owner desires to give goods/services in response to a donation on an OpportunityToServe campaign, they must first receive approval from OpportunityToServe prior to launching such a campaign.

Donations made to non-profit and political funding destinations may be used at the discretion of the organization that receives the donations. Users contributing to political campaigns are responsible for ensuring compliance with all applicable election laws, including Donation limits and disclosure requirements.

In the event that our anti-fraud systems detect behavior which suggests fraudulent use of stolen cards (including "card testing"), we will refund those Donations without receiving a request from you or the intended recipient and terminate the affected fundraising campaigns, at our discretion. OpportunityToServe may require campaign owners and recipients to provide additional verification documents before disbursing funds. Failure to complete verification may result in delays or cancellation of payouts.

Recipients are not required to accept your Donations through the Services. You agree that we have no liability to you resulting from any Recipient's non-acceptance or refund of any Donation. While OpportunityToServe makes reasonable efforts to ensure that all Donations are deposited to their intended Recipients, in the event that a recipient fails for one year to request a disbursement from OpportunityToServe which includes your Donation or affirmatively refuses a Donation processed by OpportunityToServe, your Donation will be re-designated as follows:

  • A. for nonprofit donations, the rejected or unclaimed donations will be re-designated to OpportunityToServe, the registered 501(c)(3) organization;
  • B. for all other donations including peer-to-peer, peer-to-business, and political donations, the rejected or unclaimed donations will be re-designated for use at the discretion of OpportunityToServe, LLC.

You are responsible for all chargebacks, chargeback fee of $15 for each chargeback, refunded or voided Donations, or other credits or adjustments, fees, interest, penalties or the like in connection with your use of the Services. Donations may be refunded, voided or adjusted due to, among other things: (a) voiding or adjustment by your bank or card issuer; (b) correction of manifest error; (c) claims made by us or others against you; and/or (d) any actual or proposed Donation in violation of this Agreement or applicable law. If we pay any claim, chargeback, refunded or voided Donation that you make against a Recipient, you agree that we assume your rights against the Recipient, and may pursue those rights directly or on your behalf.

If you register to create a Recipient account to receive payments via our application, you expressly authorize any of OpportunityToServe or its service providers to originate credit transfers to your financial institution account. You must be at least 18 years old to receive funds. You authorize us to collect and share with our payment service providers your personal information including full name, email address and financial information, and you are responsible for the accuracy and completeness of that data.

As an OpportunityToServe user, the online donation page you publish may be publicly available on the internet, for all to see, including search engines like Google and Yahoo. Your activity is public.

As part of the registration process, you agree to provide:

  • Information about yourself that is truthful, current, complete, and accurate; and
  • Update this information so as to maintain its accuracy.

You are solely responsible for maintaining the confidentiality of your password, username and all uses of your Campaign Account regardless of whether you have authorized such uses. You shall not share your account with anyone else. You agree not to use the account, username or password of anyone else. You shall not disclose your password to anyone else.

All of your registration information must be accurate and truthful. You agree to notify OpportunityToServe immediately if you discover that your User account has been used without your authorization or there has been any other breach of your User account's security. You also agree to provide additional information we may reasonably request and to answer truthfully and completely any questions we might ask you in order to verify your identity.

D. Refund and Cancellation Policy

Refunds for your base Donation may only be issued prior to the transfer of funds to the recipient. After transfer occurs, refunds must be secured from the recipient of your Donation. For all donation types, these transfers can occur as soon as the next day of your donation.

Requests to change the recipient of a base Donation amount may only be requested prior to the transfer of funds to the recipient. After transfer occurs, the funds cannot be sent to another recipient. For all donation types, these transfers can occur as soon as the next day of your donation.

You may request a full or partial refund on any optional tip that was earmarked for OpportunityToServe during your donation checkout for up to 14 days after the donation was made, regardless of if the base donation has been transferred to the recipient or not.

E. Acceptable Use Policy

In connection with your use of any Services, you agree not to, directly or indirectly:

  • use any Services in any way that would breach this Agreement or would be abusive, harassing, tortious, or otherwise could result in civil or criminal liability or in excessive non-acceptance, refunds and/or chargebacks of Donations;
  • violate any applicable law, rule or regulation, including election, campaign finance, and/or tax law, rules or regulations, and/or debit/credit card system or association rules;
  • send or receive funds obtained by or connected with fraud;
  • use any Services in connection with unsolicited or unauthorized email or other unethical or illegal methods;
  • provide false or misleading information or impersonate any person or entity, including, but not limited to, any representative of us or any Recipient, or misrepresent your affiliation with any person or entity;
  • refuse to reasonably cooperate in any investigation related to the Services;
  • intercept, monitor, interfere with or disrupt any Services or the servers, networks or communications systems connected to them or any security functionality of us or any third party;
  • use or introduce any spyware, adware, viruses, trojan horses, worms or similar invasive, destructive or self-replicating code in connection with the Services; or
  • use any automated system, such as "robots" or "spiders," to access our systems or Services significantly faster than a human or to monitor activity on such systems or Services. We shall be the sole arbiter as to what activities violate the foregoing;

Campaigns that are racist, hateful, potentially libelous, support or promote physical violence, or are intended to financially benefit individuals for the commission of violent crimes are not permitted. Campaigns seeking to raise funds for individuals charged with crimes will be allowed if the stated purpose is legal defense or related, lawful needs. Campaigns that seek to financially reward, glorify, or support the lifestyle of individuals convicted of violent crimes — without clear justification such as legal appeals, humanitarian needs, or clear evidence of rehabilitation — are not permitted. Past convictions do not automatically disqualify someone from fundraising if the campaign's purpose is unrelated to the crime and does not promote or celebrate it.

All campaigns are subject to internal review for compliance and OpportunityToServe reserves the right to cancel or suspend any campaign for any reason.

If you know that your Campaign is claiming to do the impossible or it's just plain phony, don't post it. You must comply with all applicable laws and regulations in carrying out your Campaign.

F. Privacy and Other Policies

Your use of the Services is subject to our Privacy Policy and other applicable policies, each as established by us from time to time, available at https://www.OpportunityToServe.com/privacy-policy which are incorporated herein by reference. We shall disclose to Recipients and, if required, governmental bodies such information about you as a Contributor as must be disclosed by law or as may be necessary in order for Recipients to comply with applicable laws. In many cases of political donations, such governmental bodies are required to make your information public.

G. Content and Communications

You understand that by using the Services, you may be exposed to content that is inaccurate, offensive or objectionable, as further described in the User Content section above. The Services, or content or third parties included on the Services, may provide links to other Internet sites or resources, as described in the Linking to Third-Party Websites section above. Because we have no control over such content, sites or resources, you acknowledge and agree that we do not endorse and are not responsible or liable for anything on or available via such content, sites or resources. You may communicate directly with persons or entities mentioned on the Services, and you agree that we have no liability or responsibility for such communications, as further described in the Interactions with Others and No Control Over Third Parties sections above. Our platform includes features for users to flag inappropriate content, and this method can and should be used to notify us of any content that needs to be reviewed by our moderators.

H. Documentation and Tax Implications

OpportunityToServe, LLC may share a Contributor's name, email, and donation amount with Campaign owners and Recipients. You will receive an email receipt from OpportunityToServe, LLC when your card is billed, which will serve as your acknowledgement of your Donation. The Donation may appear on your statement with "OpportunityToServe" or a similar descriptor, whether processed by OpportunityToServe, LLC on behalf of a Recipient or for OpportunityToServe. OpportunityToServe, LLC makes no representation or warranty that any Donation is tax-deductible. You agree to be responsible for the tax reporting and characterization of any Donation from your account to any Recipient. When donations are processed for OpportunityToServe (the 501(c)(3) organization), receipts will identify OpportunityToServe and include the required IRS statements. Donations to non-charitable recipients are generally not tax-deductible.

I. Ownership of Uploaded Content

By uploading images, text, and video to OpportunityToServe, you acknowledge that you have the right to do so and that the content uploaded to OpportunityToServe does not violate any copyrights of the owner. OpportunityToServe reserves the right to remove any content that violates an owner's copyright and ban users from the OpportunityToServe platform who repeatedly violate this term.

J. Specificity of Fundraising Commitments

Unless you are an authorized representative of a funding destination, you may not pledge or promise that funds raised through your OpportunityToServe campaign will be used for any specific purpose. OpportunityToServe reserves the right to remove any campaigns that violate this term. OpportunityToServe does not engage in any solicitation activities; such activities are carried out by you on your own initiative.

K. AI Generated Content

Content created with My Intelligent Campaign Assistant or other AI tools is considered user-generated, and users assume full responsibility for its accuracy, legality, and compliance with these Terms of Service. OpportunityToServe is not liable for any damages resulting from the use of AI tools or their content.

L. Agent of the Payee Authorization

By creating a campaign on OpportunityToServe, you ("Campaign Owner" or "Recipient") expressly authorize OpportunityToServe to act as your authorized agent for the limited purpose of receiving and processing donations made by Donors to your campaign.

You acknowledge and agree that:

i. Payment to OpportunityToServe Constitutes Payment to You
When a Donor donates to your campaign, those funds are considered received on your behalf once they are successfully processed by OpportunityToServe. The Donor's obligation to you is fully satisfied when OpportunityToServe receives the donation, and the Donor has no further claim to those funds.

ii. OpportunityToServe Holds Funds as Your Agent
OpportunityToServe collects and holds funds for the purpose of disbursing them to you in accordance with our policies. You grant OpportunityToServe the authority to initiate transfers and distribute funds to your designated bank account, minus any applicable fees.

iii. Fund Disbursement & ACH Transfers
Upon successful completion of any required verification (such as Know Your Customer (KYC) and Anti-Money Laundering (AML) compliance), OpportunityToServe will transfer funds to you. OpportunityToServe may use PayPal or an alternative PayPal-enabled disbursement method via its banking partners. You acknowledge that disbursements are subject to processing times and that OpportunityToServe is not liable for any delays caused by banking institutions or third-party processors.

iv. No Custodial Relationship
OpportunityToServe does not act as a bank, money transmitter, or financial institution but rather as your agent to facilitate the receipt and disbursement of funds. Funds held by OpportunityToServe are not insured deposits and are not subject to FDIC or similar protections.

v. Compliance with Applicable Laws
You agree to comply with all applicable laws, including but not limited to state and federal anti-money laundering (AML) and counter-terrorism financing (CTF) regulations. OpportunityToServe reserves the right to delay or withhold disbursements if legally required or if fraud, misuse, or regulatory violations are suspected.

By using OpportunityToServe, you acknowledge and expressly authorize OpportunityToServe to act as your agent for receiving and distributing funds related to your campaign.

4. Our Fees ("Fees")

A. OpportunityToServe has a 0% platform fee for all donation campaigns, regardless of destination type.

B. You agree to pay all payment processing fees for your transactions at the prices set by our payment processor(s) then in use, currently set at 2.9% plus $0.49 per transaction paid via credit or debit card in the USA (PayPal), which will be deducted out of your gross donation amount before the net amount is passed onto the recipient. Donations to campaigns outside the USA, and Donations made outside the USA to campaigns inside the USA are subject to varying payment processing fees and currency conversion rates, which may be determined by our payment processor or financial institution partners. We reserve the right at our sole discretion to set or revise fees from time to time. Donations to campaigns outside the USA are subject to international pricing.

C. If you make payment by credit or debit card, and our merchant processor(s) refuses to accept or revoke acceptance (e.g., by chargeback) of your Donations or other payments, you agree to pay all amounts due upon demand by us. In such event, if any amounts due to us are not paid when due, such amounts shall be subject to a late fee of 1.5% per month or the maximum amount allowed by law on such late amounts, whichever is less, and you also will reimburse us for the reasonable costs of collection, including without limitation reasonable attorneys fees and expenses. Each time you use any Services that result in a Donation to be made, or allow or cause such Services to be used, you agree and reaffirm that we are authorized to charge your designated card. Your card issuer's agreement governs your use of your designated card in connection with the Services, and you must refer to such agreement concerning your rights and liabilities as a cardholder.

D. If you have any questions regarding any charges that have been made via the Services, you must contact our service department within 30 days of the charge date, subject to the Refund Policy in section 3.D.

E. In the event of a refund request, Donations will be refunded minus the applicable payment processing fees for your jurisdiction.

F. If a Donation is disputed by the Donor, a $15 dispute fee will be charged/removed from the balance owed to the Recipient of a campaign. Campaigns experiencing an unusually high rate of chargebacks may be subject to review, suspension, or additional verification requirements before further disbursements are processed.

G. Funds contributed through OpportunityToServe may be temporarily held in a pooled account maintained by OpportunityToServe with a licensed financial institution. Any interest earned on these funds is retained by OpportunityToServe as a treasury management fee and is not distributed to campaign owners or recipients.

5. Suspension or Termination

A. We reserve the right to suspend or terminate your use of any of the Services (e.g., by not processing pending Donations) and/or this Agreement without notice at any time and with or without cause. Without limiting the foregoing, we may suspend or terminate your use and/or this Agreement upon any of the following: card expiration, insufficient funds, rejection of any Donation, payment or card charges, violation of our Acceptable Use Policy or other policies, if your accounts are frozen, if a legal order directs us to suspend or terminate providing the Services to you or otherwise limits or prohibits Donations by you, or if your financial institution (or its agent or affiliate) seeks return of amounts previously paid to us when we believe you are liable for the charge. Such rights are in addition to and not in lieu of any other legal rights or remedies available to us. In cases of account termination, OpportunityToServe may, but is not required to, provide notice if legally permitted. Users whose accounts are suspended may contact Support for clarification.

B. You may terminate your use of the Services and this Agreement at any time, with or without cause, upon written notice.

6. Modifications to this Agreement and/or Services

A. We may amend this Agreement at any time by (a) posting revised Terms of Service accessible via websites for the Services, and/or (b) sending information regarding the amendment to your email address of record with us. You are responsible for regularly reviewing such websites to obtain timely notice of such amendments. You shall be deemed to have accepted such amendments by continuing to use any Services after such amendments have been posted or information regarding such amendments has been sent to you. If you do not agree to any of such changes, you may terminate this Agreement and immediately cease all access and use of the Services. You agree that such termination will be your exclusive remedy in such event. If you do not agree to any changes in this Agreement, you may terminate your use of the Services within 10 days of notice without penalty. Continued use beyond this period constitutes acceptance of the revised Terms.

B. We reserve the right at any time and from time to time to modify or discontinue all or any portion of any Services without notice to you. We shall not be liable to you or any third party should we exercise such rights. We may specify from time to time the version(s) of related products required to use the Services (e.g. browsers, hardware, and operating systems).

7. Disclaimer of Warranties and Limitation of Liability

A. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND NEITHER WE NOR ANY OF THE OWNERS OF SITES THAT LINK TO OR DISPLAY DONATION FORMS OR PAGES PROVIDED BY US ("SPONSORS") NOR OUR SUPPLIERS OR AGENTS MAKE ANY EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES TO YOU REGARDING THE SAME. WE AND OUR SPONSORS, SUPPLIERS AND AGENTS DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, OR SECURITY, AND DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

B. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY DIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, RESULTING FROM OR ARISING OUT OF YOUR USE OF, OR YOUR INABILITY TO USE, THIS SITE OR THE MATERIALS OF THIS SITE OR ANY LINKED WEBSITE (OR THE SERVICES PROVIDED OR ARRANGED THROUGH THIS SITE), INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY CLAIMS, LOST WAGES, PROPERTY DAMAGE, LOST PROFITS, BUSINESS INTERRUPTION, AND LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM. 8. OUR LICENSE TO YOU/RIGHTS AND LICENSES

A. OpportunityToServe's Ownership Rights
OpportunityToServe, LLC and its licensors own all right, title and interest, including without limitation all worldwide intellectual property rights in OpportunityToServe's Products and Services, and all such rights to all derivative works or enhancements of, in and to, or relating to, the OpportunityToServe Products and Services. By entering into this Agreement or by Your participation, You will not acquire any intellectual property or similar rights in the OpportunityToServe Products and Services other than a limited right to use the Products and Services for Your personal benefit. You agree You will not:

  • Remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the OpportunityToServe Products and services
  • Use OpportunityToServe's name, logo, trademark, trade names or service marks except as expressly permitted in this Agreement without OpportunityToServe's prior written consent.

B. Your Ownership Rights
Subject to the licenses granted in this Agreement (including the User Content License Grant above), you retain all right, title and interest, including without limitation all worldwide intellectual property rights, in and to your Content that is submitted, posted or displayed by you on or through OpportunityToServe.com. By posting or providing Content, you grant OpportunityToServe the licenses described in the User Content License Grant section, which supplements and does not limit the rights granted herein. OpportunityToServe shall not acquire ownership of your Content except as provided herein. Any rights not granted by you herein are deemed retained by you. You represent and warrant that your User Content and our use of your User Content will not infringe any third party's intellectual property rights, proprietary rights, privacy rights, confidentiality, rights of publicity or otherwise violate these Terms or applicable law.

You agree that You shall not create or distribute information, including but not limited to advertisements, press releases or other marketing materials, or include links to any sites which offer such information:

  • Containing or suggesting an endorsement by OpportunityToServe of You or Your Content
  • Relating to this Agreement, without the prior review and written approval of OpportunityToServe. Notwithstanding the foregoing, You may accurately disclose and describe Your Participation and Your Content (for example, describing and promoting Your Content on Your blog, social media sites, or in emails).

You understand that all fundraising campaigns, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated…

The compilation (meaning the collection, arrangement and assembly) of all content on the OpportunityToServe website is the exclusive property of OpportunityToServe and is protected by United States and foreign copyright, trademark, and other laws. Unauthorized use of the OpportunityToServe.com Content may violate these laws, and is strictly prohibited. You may use the Site and its content and materials only for the purposes stated in this Agreement. You may copy such content for your own personal, non-commercial use only, or as otherwise provided herein, provided you do not alter it or remove any copyright, trademark or other proprietary notice.

In the event of any dispute, such as a Campaign Owner's alleged failure to comply with the Terms or alleged failure in completing a Campaign, we may provide the Campaign Owner's contact information to the Donor so that the two parties may resolve their dispute. If a Campaign Owner is found to be in violation of the terms of this Agreement, OpportunityToServe also reserves the right to terminate the Campaign Owner's account(s). OpportunityToServe does not warrant that funds will be used for any particular purpose and is not responsible for any misuse of the funds by the Campaign Owner or the intended beneficiary. In addition, donations made on OpportunityToServe are non-refundable. All further dealings following a Donation are solely between Donor and Campaign Owner or the intended recipient.

You may terminate your account by following the instructions on the Service, but we may retain your account information after you terminate in accordance with our regulatory, accounting, and legal compliance procedures. All provisions of the Terms of Service that by their nature shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. You agree that OpportunityToServe, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason, including, without limitation, if OpportunityToServe believes that you have acted inconsistently with the letter or spirit of the Agreement. Further, you agree that OpportunityToServe shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use the Service after said termination.

9. Indemnification

You agree to defend, indemnify, and hold harmless OpportunityToServe, LLC and each of our officers, directors, members, managers, employees, agents, volunteers, affiliates, Sponsors, suppliers, and contractors from and against any and all claims, demands, losses, liabilities, damages, penalties, fines, expenses (including reasonable attorneys' fees and costs), and causes of action arising out of or related to: (a) your use of the Services or the Site; (b) your User Content or Content; (c) your breach of this Agreement or violation of applicable law; (d) your campaigns, needs, listings, solicitations, or communications; (e) any dispute between you and another user, Recipient, Donor, volunteer, organization, or third party; (f) any volunteer, in-kind, pickup, delivery, or in-person activity connected to your use of the Services; (g) chargebacks, refunds, fraud, or payment disputes attributable to you; (h) any allegation that your content or conduct infringes or violates the rights of a third party, including intellectual property, privacy, or publicity rights; (i) your tax, election, charitable solicitation, or regulatory obligations; (j) content created with AI tools or other automated assistance; and (k) any unauthorized use of an Organization Account or representation that you have authority to act for an organization.

We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You may not settle any claim in a manner that imposes any obligation on us without our prior written consent.

Notices given by us to you will be given by general posting on our website, or by email, overnight courier, first class or express mail to your address of record at our offices. 11. Dispute Resolution; Governing Law; Forum

A. Governing Law. This Agreement is governed by the laws of the State of Wyoming, U.S.A., without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 11(B) below.

B. Binding Arbitration. Except for claims for injunctive or equitable relief relating to our intellectual property, unauthorized access, scraping, or misuse of the Site, you agree that any dispute, claim, or controversy between you and OpportunityToServe, LLC arising out of or relating to this Agreement or the Services (each a "Claim") shall be resolved by binding arbitration. Arbitration replaces the right to appear in court, and you waive any right to a jury trial for such Claims. Either you or we may require submission of a Claim to binding arbitration at any reasonable time, even if a lawsuit or other proceeding has already begun.

C. Class Action Waiver. Neither you nor we may join or consolidate Claims by or against the other in any arbitration, or include any Claim as a representative or member of a class, or act in any arbitration in the interest of the general public or in a private attorney general capacity.

D. Arbitration Procedures. The party filing a Claim in arbitration must file before a single arbitrator appointed by the American Arbitration Association ("AAA") under its then-current commercial disputes rules. For any Claim of less than $10,000, we may elect non-appearance-based arbitration through AAA or another mutually approved provider by telephone, video conference, online submission, or written submissions. The arbitrator must be a lawyer actively engaged in the practice of law or a retired judge with relevant expertise.

E. Arbitrator Authority and Court Review. The arbitrator may not vary the terms or conditions of this Agreement. The arbitrator's award shall be final and binding, except that either party may seek judicial relief to enforce an award or to challenge an award on grounds permitted by law.

F. Costs and Self-Help. The parties shall share equally the costs assessed by the AAA or the arbitrator and other joint arbitration costs, but each party shall bear its own attorneys' and experts' fees unless applicable law or the arbitrator's award provides otherwise. Nothing in this section prevents lawful self-help remedies, such as setoff rights.

G. Court Forum for Excluded Claims. For Claims excluded from arbitration under Section 11(B), or to enforce an arbitration award, you agree that exclusive jurisdiction and venue shall lie in the state or federal courts located in Laramie County, Wyoming, U.S.A., and you consent to personal jurisdiction in those courts. The Service is deemed based in Wyoming and passive with respect to jurisdiction outside Wyoming, except as expressly provided in this Agreement.

H. Forum Non-Compliance. If you bring a court action that is required to be arbitrated under this Section 11, we may move to dismiss or compel arbitration, and you agree that we may recover our reasonable attorneys' fees, costs, and disbursements if we prevail on such a motion.

12. Anti-Scraping Clause

A. Prohibition on Unauthorized Data Scraping and Automated Access
You agree not to use any automated means, including but not limited to scripts, bots, crawlers, or data mining tools, to access, monitor, or copy any content or data from the OpportunityToServe website, application, or platform without prior written permission from OpportunityToServe.

Exception: This prohibition does not apply to indexing or crawling by reputable search engines (such as Google, Microsoft Bing, or other similar services) that comply with our robots.txt file and are acting solely for the purpose of including OpportunityToServe in public search results.

B. Permissible Use
You may access the content and data made available on the OpportunityToServe website solely through standard web browsers and user interfaces provided by OpportunityToServe. Any attempt to bypass or circumvent these access methods, including but not limited to the use of unauthorized third-party software or tools, is prohibited.

C. Intellectual Property and Data Rights
All data and content available on the OpportunityToServe website, including but not limited to text, images, videos, user-generated content, and metadata, are the intellectual property of OpportunityToServe or its respective users. Unauthorized copying, extraction, or reproduction of this content through automated means constitutes a violation of OpportunityToServe's intellectual property rights.

D. Enforcement and Legal Action
OpportunityToServe reserves the right to monitor any unauthorized scraping activities and may take action to prevent or terminate such activities, including but not limited to blocking access, issuing cease-and-desist letters, or pursuing legal remedies under applicable laws, including the Computer Fraud and Abuse Act (CFAA).

E. Consequences of Violations
Any violation of this clause may result in immediate suspension or termination of your access to the OpportunityToServe website, as well as potential legal action. You agree to indemnify and hold OpportunityToServe harmless from any claims, damages, or liabilities arising from your unauthorized data scraping activities.

13. Force Majeure

OpportunityToServe, LLC shall not be liable for any delay, failure, interruption, or unavailability of the Services resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, utility or internet failures, hosting or cloud provider outages, payment processor downtime, banking delays, government action, regulatory orders, epidemics, or failures of third-party suppliers or contractors. Our performance shall be excused for so long as such event continues.

General Terms

A. Disclaimer
Campaign Owners should be aware that many states impose charitable fund solicitation laws to guide direct or indirect fund solicitation activities in those states. While provisions vary state to state, these state laws typically include registration and reporting requirements. We merely provide a technology platform to allow Campaign Owners to connect with Donors and Users. Those who access or use the Service do so at their own volition and are entirely responsible for compliance with applicable law.

B. Anti Money Laundering and Terrorist Financing Statement
OpportunityToServe is committed to full compliance with all applicable laws and regulations regarding Anti-Money Laundering ("AML"). OpportunityToServe's policy is to prevent people engaged in money laundering, fraud, and other financial crimes, including terrorist financing, from using OpportunityToServe's services. PayPal, our third-party payment processor, has robust policies and procedures to detect, prevent and report suspicious activity. To comply with OFAC (Office of Foreign Asset Control) requirements, and global sanctions, they screen customer accounts against government watch lists. In addition, they may request that our users provide them with documentation to help prove their identity or for business verification purposes. They will report suspicious transactions to the financial intelligence unit in the respective country. Please see our AML/KYC policy in our Privacy Center for further information.

C. English Language
In the event of a conflict between these Terms and a foreign language version of our Terms of Service, the English language version of these Terms govern. All disputes, claims and causes of action (and related proceedings) will be communicated in English.

D. Cooperation with Authorities and Legal Notification.
We will cooperate with law enforcement authorities as required by law. We will cooperate with law enforcement agencies in any investigation of alleged illegal activity regarding the use of the Service when requested.

You agree OpportunityToServe may provide notifications to you via email, written or hard copy notice, or through conspicuous posting of such notice on our website. You may opt out of certain means of notification or to receive certain notifications.

E. Severability/Entire Agreement
These Terms are the entire agreement between you and OpportunityToServe, LLC regarding their subject matter and supersede all prior or contemporaneous agreements, representations, and understandings relating to the same subject matter. There are no third-party beneficiaries to this Agreement except as expressly stated. If any provision of this Agreement is unlawful, void, or unenforceable in whole or in part, the remaining provisions will not be affected. If two or more provisions are deemed to conflict with each other's operation, OpportunityToServe, LLC, shall have the sole right to elect which provision remains in force. OpportunityToServe's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

G. The laws of the State of Wyoming, U.S.A., excluding its conflicts of law rules, govern this Agreement and your use of the Services, except as otherwise provided in Section 11. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. You may not assign or transfer this Agreement or any rights hereunder without our prior written consent, and any attempt to the contrary shall be void. We may assign this Agreement, in whole or in part, without restriction. Subject to the preceding sentence, this Agreement benefits and binds the respective successors and assigns of the parties. We at our sole discretion may contract with third parties to process payments and/or provide any other of the Services. Sections 2, 3, 4, 6, 7, 8, 9, 11, 12, and 13, together with all provisions that by their nature should survive (including payment obligations, ownership provisions, warranty disclaimers, indemnity, releases, and limitations of liability), shall survive termination of this Agreement.
